Section 504 is a part of the Rehabilitation Act of 1973 that prohibits discrimination based upon disability.  Section 504 is an anti-discrimination, civil rights statute that requires the needs of students with disabilities to be met as adequately as the needs of their non-disabled peers. To be eligible for protections under Section 504, the child must have a physical or mental impairment.  This impairment must substantially limit at least one major life activity.  Major life activities include walking, seeing, hearing, speaking, breathing, learning, reading, writing, performing math calculations, working, caring for oneself, and performing manual tasks.  The key is whether the child has an "impairment" that "substantially limits . . . one or more . . . major life activities."  If a student meets the criteria, an accommodation plan can be written that prevents discrimination in the school environment.

 

Section 504 states:

No otherwise qualified individual with a disability in the United States, as defined in section 706(8) of this title, shall, solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance...” [29 U.S.C. §794(a), 34 C.F.R. §104.4(a)].

 

Any student or parent or guardian (“grievant”) may request an impartial hearing due to the school system’s actions or inactions regarding your child's identification, evaluation, or educational placement under Section 504.  Requests for an impartial hearing must be in writing to the school system’s Section 504 Coordinator; however, a grievant’s failure to request a hearing in writing does not alleviate the school system’s obligation to provide an impartial hearing if the grievant orally requests an impartial hearing through the school system’s Section 504 Coordinator.  The school system’s Section 504 Coordinator will assist the grievant in completing the written Request for Hearing.  The Section 504 Coordinator may be contacted through the school system’s central office.  Copies of the 504 Procedural Safeguards and Notice of Rights of Students and Parents Under Section 504 may be found at the system website or may be picked up at the central office or at any of the school offices.
